Implications of the Liberty Protection Safeguards

Unlawful deprivation of liberty (DoL) has been widespread in health and social care since the Cheshire West judgment in March 2014, expanding the definition of DoL in this context and swamping the existing system to protect patient’s rights, the Deprivation of Liberty Safeguards (DoLS). DoLS are now due to be replaced entirely by the Liberty Protection Safeguards shortly, with significant impact on all providers of health and social care, who will need to be aware of the key changes and the new system, to protect patient rights in an efficient and cost effective way, and to avoid potential new liabilities.
